FDA’s Ruling to Halt Tirzepatide Compounding

On May 7, 2025, U.S. District Judge Mark Pittman upheld the FDA’s removal of Eli Lilly’s tirzepatide products (Mounjaro® and Zepbound®) from the Federal Drug Shortage List, enforcing a March 19 deadline for all compounding pharmacies to cease production of essentially identical copies. This ruling confirms that the national supply of tirzepatide now meets current and projected demand, and underscores that mass‑produced “copycat” versions are no longer legally justifiable.

From Shortage Exception to Prohibition

During the 2022–2024 tirzepatide shortage, § 506C of the Federal Food, Drug, and Cosmetic Act allowed 503A and 503B compounders to import active ingredients and prepare injections when the branded supply fell short. Now that Lilly has demonstrated consistent manufacturing capacity, the FDA has reaffirmed that compounded versions, essentially a copy of approved tirzepatide, violate the Drug Quality and Security Act and must be phased out to protect patient safety and market integrity.
